DRAFT — ATTORNEY REVIEW REQUIRED. This document is a draft prepared for TENGAIKOKO LLC and has not been reviewed by a licensed attorney. It should be reviewed and approved by qualified legal counsel in Michigan before it is published or relied upon. Nothing in this document constitutes legal advice.

TENGAIKOKO LLC ("Tengaikoko," "we," "us," or "our") operates the website at tengaikoko.com (the "Site"). This Privacy Policy explains what information we collect, how we use it, and the choices you have. By using the Site, you agree to the practices described in this policy.

Zimbabwe. Zimbabwe data protection details are pending legal review.

1. Information We Collect

(a) Information you provide directly:

  • Contact information: name, email address, phone number, and mailing addresses (U.S. and Zimbabwe);
  • Account credentials: username and password (stored in hashed form);
  • Order and delivery details: the products you buy, delivery and recipient details, and any delivery instructions;
  • Payment information: processed through PayPal, our payment processor. We do not store full payment card numbers on our servers;
  • Communications: messages, emails, and support requests you send to us.

(b) Information collected automatically:

  • Device and usage data: browser type, operating system, pages visited, time spent on pages, and referring URLs;
  • Page-view analytics (see Section 3). For that counter we do not store your raw IP address — only a one-way hash, plus an approximate location (city, region, country) derived from the IP at the time of the visit;
  • Terms acceptance and security: we store your IP address when you accept the Terms or Privacy Policy, and on security records such as sign-in sessions and audit logs.

(c) Information from third parties:

  • Shipping carriers and delivery partners may provide tracking updates and delivery confirmations related to your orders;
  • Customs authorities may provide duty assessments and clearance status.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Services, including generating shipping quotes and tariff estimates;
  • Process, combine, ship, and track your orders;
  • Communicate with you about quotes, shipments, account activity, and service updates;
  • Process payments and prevent fraud;
  • Comply with legal obligations, including U.S. export regulations and Zimbabwe import requirements;
  • Analyze Site usage to improve functionality and user experience;
  • Send service-related notices. We will not send marketing communications without your consent.

3. Cookies and Analytics

We run our own lightweight, first-party page-view analytics — no third-party analytics service. When you visit a page, we record the page path, the referring site, your browser/device type, and an approximate location (city, region, country) derived from your IP address at that moment. For this counter, your raw IP address is not stored — only a one-way hash of it, plus the derived location. We do store your IP address for terms acceptance and security, as described in Section 1. The counter provides aggregate statistics about Site visits and does not collect personal data for advertising purposes. We do not collect age, gender, or advertising identifiers through this counter.

We may also use strictly necessary cookies or local storage to maintain your session and remember your preferences. You can control cookies through your browser settings; disabling them may affect Site functionality.

We do not use advertising trackers or sell your data to advertisers.

App permissions — plain and simple: Tengaikoko does not use your microphone or precise location. The only location we ever see is an approximate one (city, region, country) derived from your internet address, used for the analytics described above. Camera (optional): on the Track order page you can choose to scan the code on your receipt or parcel with your camera instead of typing it. The camera only starts when you tap scan, the image is read on your device to find the code, and no photo or video is sent to us or stored. You can always type the code instead. If your browser asks for camera, microphone, or location access at any other time, you can safely say no — everything works without them.

4. How We Share Your Information

We share your information only as necessary to provide the Services:

  • Delivery partners: we share delivery details (your name, addresses, item descriptions, and declared values) with the delivery partners who carry your order, and with customs brokers as required to deliver and clear your order;
  • Payment processor: payment information is shared with PayPal, our payment processor, to take a payment;
  • Partner repair shops: for a warranty repair, we share the details the shop needs to do that repair;
  • IMEI check provider: when we check a device, the device identifier (such as an IMEI) may be shared with the IMEI check provider;
  • Service providers that process data for us, only as needed for the purpose listed:
    • Anthropic (AI assistant): the questions you type into our shopping assistant, and product details and photos when our team drafts listings. We don't send your payment details to it;
    • Africa's Talking (text messages): your phone number and the one-time sign-in or verification code we text you;
    • Resend (email delivery): your email address and the order and account emails we send you;
    • Vercel (website hosting) and Neon (database hosting): store and serve the Site and your account and order data.
  • Legal compliance: We may disclose information when required by law, court order, or government regulation, or to protect our rights, property, or safety, or that of others;
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the successor entity.

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including encrypted connections (HTTPS), hashed password storage, and restricted access to personal data. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide the Services, comply with legal obligations (including tax and customs record-keeping requirements), resolve disputes, and enforce our agreements. Shipment and transaction records may be retained for up to seven (7) years to satisfy regulatory requirements.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you;
  • Request correction of inaccurate information;
  • Request deletion of your personal information (subject to legal retention requirements);
  • Object to or restrict certain processing of your information;
  • Receive a portable copy of your information.

To exercise any of these rights, contact us at the address in Section 10. We will respond within a reasonable timeframe.

8. Children's Privacy

The Site and Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected information from a child, we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be announced by posting the revised policy on the Site with an updated "Last updated" date. Your continued use of the Site after such posting constitutes acceptance of the revised policy.
